Mandatory Tip Sharing: A No-No

A bartender who was terminated for refusing to share tips prevailed in a claim of wrongful termination against his former employer. Although the Minnesota Fair Labor Standards Act (MFLSA) clearly states that employers may not require employees to share wages, it doesn’t explicitly prohibit employers from terminating an employee for refusing to share wages. Nonetheless, the Court reasoned that the logical implication of the prohibition against forced tip sharing is that an employee should be able to sue for wrongful termination if not sharing tips was the reason he was fired.
